1. Acceptance of Terms

By accessing or using Lumee-O, you agree to these Terms of Use. If you do not agree, you should not use the Service. If you are using Lumee-O on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. Eligibility and Authority

You may use Lumee-O only if you are legally able to form a binding contract and have authority to provide the information you enter. Organisation users should ensure they have authority from their organisation to use the Service on its behalf.

3. Individual and Organisation Accounts

Individual accounts are for a single user. Organisation accounts allow administrators to invite team members who share a workspace. Administrators are responsible for managing their organisation's members and permissions.

4. Account-Security Responsibilities

You are responsible for:

  • Keeping your login credentials confidential and using a strong, unique password.
  • All activity that occurs under your account.
  • Promptly removing former team members from your organisation.
  • Notifying us of any suspected unauthorised access.

5. Description of the Lumee-O Service

Lumee-O is a property-development decision-support tool. It analyses development costs, projected sales, financing, profitability, cash flow and risk, and produces scored, stress-tested viability assessments and reports based on the assumptions you provide.

6. User Responsibility for Project Assumptions

You are responsible for the accuracy and completeness of the assumptions, costs, prices and other inputs you enter. Lumee-O's outputs depend on those inputs. You should validate assumptions against appropriate professional advice and current market information.

7. Permitted Use

You may use Lumee-O for lawful property-development analysis and related business purposes. You may use generated reports for your own decision-making and to share with your team, partners, advisers and financiers.

8. Prohibited Use

You must not:

  • Use the Service for any unlawful purpose.
  • Attempt to access another organisation's data or another user's account.
  • Misuse the Service to harm, overload or disrupt it.
  • Enter information you are not authorised to use or share.
  • Reverse engineer or attempt to extract the underlying platform in an unauthorised way.

9. Ownership of User-Provided Project Data

You retain ownership of the project information, assumptions and documents you upload. You grant Lumee-O a limited right to process that information solely to provide the Service to you and your organisation.

10. Lumee-O Intellectual Property

The Lumee-O platform, its scoring methodology, interface and branding are owned by Marilyn Smith Ltd. These Terms do not grant you any rights to Lumee-O's intellectual property except the limited right to use the Service as described here.

11. Confidentiality and Organisation Workspaces

Information within an organisation workspace is accessible to that organisation's authorised members. You should handle shared project information in line with your organisation's confidentiality expectations and applicable law.

12. Generated Reports and Permitted Use

Reports and assessments generated by Lumee-O may be used for your internal decision-making and shared with your advisers and partners. You should not present outputs as guarantees or as a substitute for professional advice.

13. Third-Party Services and Integrations

Where you connect a third-party service, that service is governed by its own terms and privacy practices. Lumee-O is not responsible for third-party services beyond the scope of the Service we provide.

14. Fees and Subscriptions

Where paid plans or one-time purchases are available, details will be shown in the Service. Fees, where applicable, are subject to the terms presented at the time of purchase. This section applies only if payment functionality is available to you.

15. Suspension and Termination

We may suspend or terminate access where there is a breach of these Terms, unlawful use, or a need to protect the Service. You may stop using the Service at any time and may request account deletion through the Account and Data Deletion page.

16. Account and Data Deletion

You can request deletion through the Account and Data Deletion Request page. Requests are reviewed and require identity verification. Submission does not immediately delete data.

17. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. Maintenance, updates and events outside our control may affect availability.

18. No Guarantee of Project Profitability

Lumee-O does not guarantee planning approval, project funding, construction cost, sales performance, profitability, investment returns or project completion. Outputs are decision-support only.

20. Limitation of Liability

To the extent permitted by law, Marilyn Smith Ltd will not be liable for indirect, incidental or consequential losses arising from your use of, or reliance on, the Service.
